View Full Version : Another IRS Lien question

Hi George,

I found an IRS Lien on a guy that has his previous address on the lien and wanted to be sure that it followed the person to his nest residence. The IRS lien was filed 08/07, he purchased another home 10/07 which is the one being foreclosed now. The IRS Lien does not show a Release of Lien. Does the Lien follow the person to this newer address even if it was filed with his old address on it? I suspect so, but wanted to ask the Pro.

I find it hard too believe that a mortgage company and title company would have aloud the new loan if the IRS lien was still in effect. That being said, I would have to say YES, the IRS lien is the 1st lien and would take priority over the mortgage you are looking to buy on the courthouse steps. Give me the address, let me take a look.

Hey George,

The address is 3017 Bayside Dr Rockwall, TX. I thought the same thing and figured either the IRS Lien was settled, but not recorded, or it was not settled and did not get recorded in time for the closing on the second residence? I will look at it again today before the auction and try to figure it out. As always, thanks for your assistance!
